Section 106 Assessments
What is a Section 106 Agreement?
A Section 106 Agreement is a legal agreement between a local authority and a developer under the Town and Country Planning Act 1990. Its purpose is to ensure that new developments include affordable housing to meet local needs.
These properties are sold or let at a price below the open market value to give local people the opportunity to buy or rent a home they can afford. The level of discount is agreed as part of the planning process.
The role of the Council
Many private properties in Gwynedd have a Section 106 agreement attached to them. When these properties are sold or re-let, the Council must assess the new applicant wishing to buy or rent the property to ensure they meet the relevant criteria.
The level of discount and the local connection conditions may vary from property to property.
If you are selling or letting a property with a Section 106 agreement attached to it, you should check the details of the condition with the Planning Service before submitting an application. A copy of the agreement must be provided to the Council for the assessment to be carried out.
Assessment fee: £75.00 per applicant.
Criteria
Applicants must:

be over 18 years old.

have a combined gross household income of between £16,000 and £60,000.

have access to a mortgage or sufficient savings and be unable to buy on the open market.

have a local connection to the area in which they wish to live, in accordance with the Section 106 agreement.

be unable to afford to buy a property suitable for their household size on the open market or through another home ownership scheme.

demonstrate that their current home is unsuitable or unaffordable.
For example, applicants may be unable to afford to buy a suitable property for their household size on the open market or through another home ownership scheme. Your current property will have to be sold before we can consider you for a property. As part of the process, you will need to provide a copy of the Completion Statement from your solicitor.
