Terms and Conditions: Menter Gwynedd Business Support Programme 26/27 Stage 1

  1. Every established business should be financially viable.
  2. The business must comply with all the appropriate regulations, all the enforcement policies and service standards that are relevant to their business sector, including that they have registered with HM Revenue and Customs (HMRC) for the purpose of paying taxes.
  3. All professional work (e.g. electrical) must be conducted by eligible contractors.
  4. The Council retains the right to contact any of the businesses who submit quotes in relation to your application, if further clarity is required.
  5. The grant cannot be used to fund goods or works provided by you, your business, or any business that you own or part own.
  6. The Council must be informed of any personal, family or business connection between you/your agency or any supplier or contractor.
  7. It is your responsibility to ensure that you have or have complied with every planning permission and any other relevant statutory permission before submitting your application. You must provide documentary evidence of this. Your business or the work that you are completing must also comply with any other relevant licences/permissions/requirements e.g. Health and Safety, and you must not use the equipment, or approve the use of the equipment, contrary to the law or any regulations/by-laws that are in force at the time.
  8. By giving you a grant, the Council does not approve anything beyond purchasing the equipment or service(s) that are in the application.
  9. No work must commence on any building until you have received every necessary approval or permission.
  10. We are unable to pay for work that has already started or any equipment that has already been purchased.
  11. The Council will not give grants to applicants who have significant debts to any Council department.
  12. The Council may check whether there is a County Court Judgement against you.
  13. When a project involves alteration or refurbishment work on a leased building, the remaining duration of the lease must be at least 5 years from the date of receiving the application from the Council. We will also require evidence of the landlord's permission.
  14. Any materials or services that will be seen by others who have received grant funding must be bilingual (Welsh/English).
  15. You are responsible for ensuring that any taxes, assessments, payments or any other expenditure that is payable in relation to using the equipment purchased with the grant.
  16. You must, on all reasonable occasions, give permission to the Council's authorised agent to enter the property to examine the state and condition of the equipment and any financial transaction books, records or documents that are relevant to the use of the equipment or the service that has been purchased with the grant.
  17. You must not assign, delete, sub-let or dispose of ownership of the equipment in its entirety or any part of it.
  18. You must ensure the equipment that has been purchased with the grant, continue to insure it against loss or damage up to the full value of replacing it. Should there be damage during the grant's agreement period and, in the opinion of the insurer, that it is not economic to compensate for such damage, all the insurance funding will be used to compensate for the loss or damage. All the premiums must be paid, and you must provide the receipts to the Council should they ask for them. You must do everything necessary to retain the total insurance cover and not do anything that would invalidate the insurance.
  19. The grant will be paid when the following occurs:
    1. A project that includes construction work has been fully completed and there is certification from the Council's Building Management Directorate (or similar) that the work is acceptable.
    2. Relevant support documents have been submitted to the Council.
  20. If creating or safeguarding jobs, the definition of 'job' is any full-time job in the business in whatever capacity, a new self-employed job or jobs that have been created by businesses moving into the county. Jobs created or safeguarded as a result of the support will be measured on a Full Time Equivalent (FTE) basis, which is equivalent to the full working week hours of the business. For example, if the business's full-time working week is 30 hours, an individual working 30 hours per week will count as 1 FTE. An individual working 15 hours per week will count as 0.5 FTE.
  21. Businesses must trade for a minimum of 30 hours per week to be eligible.
  22. You must agree to not, refuse to do or risk doing, anything that could mean that the equipment is forfeited or repossessed, or could pose a risk for this to happen.
  23. It is acceptable to purchase machines, machinery or second-hand equipment on condition that the price is fair, and it has not been originally purchased under a scheme funded by another grant.
  24. The Council retains the right to publicise awarding the grant.
  25. Any publicity arranged by you that relates to receiving the grant must recognise the plan's financial support. This is also relevant to any marketing materials/websites. There are full publicity guidelines as part of any official funding offer.
  26. Once the grant is approved, you are unable to include any additional items in the claim, unless this has been agreed by the Council.
  27. If the total expenditure is less than what was anticipated, the grant award will be reduced pro rata.
  28. The VAT can be claimed as part of the grant total if the applicant has not registered for VAT purposes.
  29. The Council must be informed in writing if there is any change to the way that you use the equipment or service purchased with the grant.
  30. During the grant's 10-year period, the Council may visit your property to conduct an inspection to monitor the business asset(s) funded by the grant.
  31. Cyngor Gwynedd retains absolute discretion regarding terms, competence and decisions for awarding grants and also retains the right to amend the criteria at any time.
  32. Every successful applicant must commit to undertaking specific activities to increase their use of the Welsh language. These activities are monitored and if they have not been completed, the grant funding may be reclaimed.
  33. Every successful applicant must commit to paying the living wage to workers over 18 years old by February 2026. The details of the plan are available on the Living Wage Foundation website (opens in new tab)
  34. Every successful applicant must undertake a Carbon Reduction Plan with support from Business Wales.
  35. Every applicant must adhere to the principles of the Gwynedd and Eryri Sustainable Visitor Economy 2035 (opens in new tab) Plan.
